Focused’s stance on refusing to participate in Swedish Derogation solution proves to be the proper approach to the Agency Workers Regulations (AWR) of October 2012.
When AWR was introduced last October a number of umbrella companies cynically exploited a legal loophole in regulations to avoid paying agency workers the same as their colleagues on permanent contracts. We took the view that it was simply not moral to use legislation to avoid paying equal pay to all employees.
This month the Communications Workers Union have taken on the case of over 1000 workers, contracted under these Swedish Derogation solutions and earning in some cases £3.00 per hour less than their permanent colleagues.
